Letter Template: Holiday Club Cancellation

This template is best suited for use when you have a contract that the provider explicitly says is not a Timeshare contract and has been signed within the last 12 months. If you have been contacted out of the blue or on the street whilst on holiday and taken somewhere to sign a contract this sample letter should be sent to the company.

 


Guidance for Using this Template Letter

  • Anything inside a bracket ( ) should be replaced with the stated information.  
  • Any reasons that do not apply to you should be deleted as appropriate.
  • We would suggest that your letter is sent registered delivery so that you know the company have received it.  We also find that this makes the complaint more formal.

 

Important Information

This template letter is designed to be a formal request for your holiday club provider to signal your intent to cancel the contract. More often than not, you will be told that you will not have cancellation rights as it is not a Timeshare contract.  If you were approached on the street and taken to a presentation to sign a contract or you are on a holiday arranged by a company to get you into a presentation, you may have cancellation rights under a different piece of law. It is common for a timeshare provider to threaten legal action or pass the debt on to a collection agent if you stop payments and request the money already paid to be refunded.  In our experience it is very unusual for these threats to be followed up through the courts when someone has considered their contract as cancelled.

Dear Sir or Madam,

RE: (contract number/receipt number/invoice number)

On the (add date) I was ** delete as applicable** approached on the street and taken to your premises to sign a holiday contract / invited to travel for a holiday with the provision that I attended a presentation where I ended up signing a contract.  Due to the way I was approached my contract can be considered an “off-premises” contract as per the Consumer Rights Directive (2011/83/EU) which has been written into each EU country’s own law.

As I have not informed of my right to cancel, the Consumer Rights Directive (2011/83/EU) extends my cancellation period by 12 months.

I would therefore like to cancel this agreement and receive back any deposit paid at the time.  Please rescind my contract with immediate effect and provide a written confirmation.

I would appreciate your prompt response but request a reply to be provided within 14 days of receipt of this letter.
